Notwithstanding encouraging developments such as the inclusion of direct selling friends in the new Administration (Carl Icahn and Betsy DeVos to name two), and the turnover of FTC commissioners, it would be a mistake for multilevel marketing companies to relax their compliance efforts. Very few of the 1,000+ employees of the FTC are going to change. And the FTC staff has invested very substantial public resources into the Vemma and Herbalife settlements, and in communicating to the industry the importance of products, customers and best practices on a myriad of industry standards. It is my expectation that enforcement efforts of the FTC and state and local regulatory agencies will continue apace, and I believe it would be a mistake for the industry to let its guard down now. The industry is in a very healthy period of self-examination and adjustment, and I am recommending to my clients that these efforts continue.
