Buchalter’s Labor & Employment team led by Shareholders Tracy Warren and Laurent Badoux successfully defended a major hotel chain against Peter Strojnik, Sr., a serial ADA plaintiff in the state of Arizona. The Arizona District Court, for the first time ever, not only dismissed the ADA Complaint and denied leave to amend, but granted the motion to have the pro per plaintiff declared a vexatious litigant. In a resounding victory for Buchalter’s client, the Arizona federal judge issued an order finding the serial ADA plaintiff engaging in litigation tactics that were frivolous and harassing. The Arizona federal judge ordered the pro per ADA plaintiff to post a bond and comply with pre-filing procedures before filing further complaints with the Court. The case, consolidated with two other cases in Arizona District Court, resulted in a first ever declaration in the state of Arizona that the pro per plaintiff, and former disbarred attorney, is a vexatious litigant, providing greater protection for public access facilities statewide. Arizona is the second state in which Buchalter’s labor and employment team had success in having the same pro per plaintiff declared a vexatious litigant.
