On May 12, 2020, Dylan Wiseman (Sacramento/San Francisco), Robert Dato (Orange County) and Alisa Pleau-Fuller (Sacramento) obtained a ruling from the Court of Appeal of the State of California, Fourth Appellate District affirming an injunction in a trade secret customer dispute. Our client, SWMH Insurance Services, Inc. (“Excelsure”) was awarded a temporary restraining followed by a preliminary injunction. Defendant ERM Insurance Brokers, Inc. appealed the preliminary injunction against it. The unanimous appellate court reviewed the evidence and concluded that Excelsure’s customer list information “was protectable as a trade secret” concluding there were ample grounds to issue the injunction. On June 10, 2020, the appellate court’s ruling was featured by Workers Comp Executive magazine.
