Buchalter's Shareholder Jennifer Misetich and Attorney Adam Smith obtained summary judgment for the City of Hermosa Beach in a matter brought by a former police officer alleging violation of the Public Safety Officers Procedural Bill of Rights Act, declaratory relief, whistleblower retaliation, and violation of the Fair Employment and Housing Act. This case stemmed from the City’s separation of the officer after he failed to become vaccinated against COVID-19 in accordance with the City’s mandate. He alleged that the City improperly denied his religious exemption request to the vaccine requirement and engaged in other unlawful behavior. Summary judgment was granted as to all claims, judgment is to be entered in the City’s favor, and “The Best Little Beach City” is elated.
