In a decision from the United States Court of Appeals for the Ninth Circuit, Buchalter Nemer was victorious in protecting a $565,655.30 judgment it obtained at trial in a copyright infringement case. Oren Bitan served as lead trial and appellate counsel.
In Randles Films, LLC v. Echo Bridge Entertainment, LLC, et. al, 2014 U.S. App. LEXIS 30 (9th Cir. Cal. Jan. 2, 2014), Buchalter client Randles Films successfully sued defendants Echo Bridge Entertainment, LLC and Quantum Releasing, LLC for infringing three copyrights protecting Randles Films’ motion picture entitled Torture Room and the screenplays on which it was based. The trial court found that defendants’ infringement rendered the film valueless and awarded Randles Films $350,000 in actual damages plus $215,655.30 in attorneys’ fees. The Ninth Circuit Court of Appeals affirmed the judgment and reasoned that Randles Films was entitled to recover all damages it suffered as a result of the infringement because the infringing acts took place in the United States. The Court of Appeals also held that Randles Films was entitled to recover its attorneys’ fees because its screenplays were registered with the U.S. Copyright Office prior to defendants’ infringement.
