Looking Forward
Again, it is not surprising that this bill was passed along party lines with Assemblyperson Mike Fong the lone exception. The bill now moves to the floor where it would be shocking if more debate and carve outs do not occur given the inadvertent impact the “ABC” test will have on numerous industries. Unfortunately, based on its current composition, it is unlikely that the Assembly amends the bill to include a carve out for franchising.
